2429 (19) NORTH LINCOLNSHIRE LOCAL DEVELOPMENT FRAMEWORK (LDF) - ADOPTION OF HOUSING AND EMPLOYMENT LAND ALLOCATION DEVELOPMENT PLAN DOCUMENT (HELADPD) - The Director of Places submitted a report informing council about the outcome of the planning inspectorate's report on the Housing and Employment Land Allocations Development Plan Document public examination in January 2015 and to consider formally adopting the Housing and Employment Land Allocations Development Plan document for decision making purposes.
The council had started work on the Housing and Employment Land Allocation Development Plan Document in 2007 and the document had been through a number of iterations and had been the subject of significant public consultation as well as Sustainable Appraisal (SA) and Habitats Regulation Assessment (HRA). The draft HELADPD had been submitted to government for independent examination in July 2014. The examination hearing, under the auspices of the Independent Planning Inspector took place between 13 and 22 January 2015. Following the examination the council was required to consult on the main modification to the document (from 10 June to 22 July 2015). The Inspector thereafter considered all relevant evidence and issued his final report on 19 February 2016.
The Inspector concluded that the HELADPD was sound, subject to the main modifications agreed during the examination hearings. A copy of the Inspector's report together with the main modifications and minor modifications were attached as an appendices to the report. In addition, the HELADPD adoption version could be viewed on the council's website. The Inspector also noted that the Sustainability Appraisal (SA) and Habitat Regulations Assessment (HRA) had been carried out. Changes had been made to both documents as a result of the main modifications and both of these documents were also available to view on the council's website. The Environmental Statement summarised the steps taken to ensure that the HELADPD was produced in accordance with the requirements of legislation governing the SA and HRA processes. Once adopted, the HELADPD would form a key document within the North Lincolnshire LDF. It would set out the overall development strategy for housing and employment allocations, town centre boundaries and development limits in North Lincolnshire up to 2026. It would then form part of the development plan for North Lincolnshire for use in making decisions on future planning applications.
The policies of the HELADPD would replace a number of policies within the North Lincolnshire Local Plan (May 2003). Further details were set out in Appendix 4 of the HELADPD. The remaining local plan policies would continue to be 'saved' until they were replaced by policies set out in other DPDs or a new local plan.
Finally the council had to note that the Planning and Compulsory Purchase Act 2004 allowed for further legal challenge to the HELADPD. Anyone who was aggrieved by the adoption of the document could apply to the High Court on the grounds that the document was not within the appropriate powers and/or a failure to satisfy a procedural requirement. Such an application had to be made no later than 6 weeks after the date of the adoption.

'(a) That the contents of the report be noted, (b) that the Housing and Employment Land Allocations Development Plan Document (HELADPD) be adopted without modification as part of the Local Development Framework, and (c) that the HELADPD be published alongside the final Sustainability Appraisal and Habitats Regulations Assessment.'
