1553 MINUTES – Resolved – That the minutes of the proceedings of this committee held on 14 June 2018, having been printed and circulated amongst the members, be taken as read and correctly recorded and signed by the chairman.

1554 SUB-COMMITTEE PROCEEDINGSResolved – That the minutes of the meeting of the Licensing (Miscellaneous) Sub-Committee held on 7 June, 26 July, 6 September, 4 October and 1 November 2018 be received.

1555 SUB-COMMITTEE PROCEEDINGS - Resolved - That the minutes of the meeting of the Licensing (Activities) Sub-Committee held on 12 July, 22 August, 2 October and 11 October 2018 be received.

1556 (22) GAMBLING ACT 2005 - REVIEW OF STATEMENT OF PRINCIPLES - The Director: Operations submitted a report that reviewed the existing Gambling Act 2005 Statement of Principles for North Lincolnshire. Section 349 of the Gambling Act 2005 required the council to have a Statement of Principles, which must be reviewed every three years.

The current Statement of Principles was approved in January 2016. A review of the policy had been undertaken. Three responses to the consultation had been received, which, alongside the revised policy, were attached to the report.

The revised policy must be approved by January 2019.

The Director guided members through the proposed amendments to the policy, and responded to members' questions.

Recommended to CouncilResolved - That the revised Statement of Principles be approved.

1557 (23) THE OPENNESS OF LOCAL GOVERNMENT BODIES REGULATIONS 2014 - The Director: Operations submitted a report that advised the committee of all decisions taken by authorised officers of the Licensing Division, in relation to licences, registrations, permits and consents, under the scheme of delegation.

In August 2014 the Government introduced regulations which required the publication of decisions by officers for non-executive functions where were for authorisation, a licence or where it affected the rights of an individual.

The adoption of the Openness of Local Government Bodies Regulations in August 2014 changed the requirements placed on local authorities in regard to reporting decisions taken under delegated authority by Officers.

Prior to the new regulations, Officers were required only to produce a report on decisions taken under authority delegated to them under the Executive powers.

The requirement had now been extended to all decisions, whether made by an officer or on behalf of another committee/sub-committee or joint committee, in which the council participated. This applied where the decision had been delegated to an officer, either under a specific delegation or under a general authorisation.

A summary of all decisions made by officers for licences, registrations, permits and consents issued between 6 June 2018 and 17 August 2018 was made available on the council's website, at the meeting and was displayed in the group offices for viewing.

Resolved - That the report be noted.

1558 APPEALS SUBMITTED TO THE MAGISTRATES COURT - Further to Minute 1519, the Director: Governance and Partnerships updated the committee on the outcome of an appeal considered by the Crown Court. This followed a decision by the Magistrates Court to dismiss an appeal against a decision made by the Licensing (Miscellaneous) Sub-Committee.

The Director: Governance and Partnerships confirmed that the Crown Court appeal had been dismissed and the council had been awarded costs.
