1610 TO APPOINT A LICENSING (MISCELLANEOUS) SUB-COMMITTEE – Resolved – That a Licensing (Miscellaneous) Sub-Committee be appointed comprising five members of the Licensing Committee, three Conservative members (Councillors K Vickers (Chairman), P Vickers (Vice-Chairman) and Clark and two Labour members (Councillors Armitage and Rayner).

1611 TO APPOINT A LICENSING (ACTIVITIES) SUB-COMMITTEE Resolved – That a Licensing (Activities) SubCommittee be appointed comprising three members (politically balanced) drawn from the 15 members of the Licensing Committee. (Membership of the sub-committee to deal with individual cases to be appointed as required from eligible members).

1612 Licensing Policy - Sex Establishments - The Director: Operations submitted the Sex Establishment Licensing Policy for approval.

The committee heard that the council had a duty to protect the public and was authorised to carry out the statutory function of issuing Licences in relation to Sex Establishments.

The council had adopted Part II of the Local Government (Miscellaneous Provisions) Act 1982 in August 2001. Licences were issued in accordance with Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982, which had been amended by Section 27 of the Policing and Crime Act 2009.

The amendment to the Local Government (Miscellaneous Provisions) Act 1982 by the Policing and Crime Act 2009 included additional activities in need of a licence. These activities included adult entertainment, such as striptease, lap dancing and pole dancing. Such activities were also licensable under the Licensing Act 2003 as regulated entertainment.

There was no legal requirement for the Policy, however it was considered to be best practice to have such a policy, thereby bringing the activity into line with other licensable activities. Consultation had taken place on the policy over a 13 week period, following approval by this committee on 22 March 2018. Only one comment was received, from Humberside Police, which was detailed at Appendix B.

Resolved – That the Sex Establishment Licensing Policy be approved, subject to the inclusion of the conditions requested by Humberside Police at Appendix B of the report.

1613 THE OPENNESS OF LOCAL GOVERNMENT BODIES REGULATIONS 2014 - The Director: Operations submitted a report advising the Committee of all decisions taken by Authorised Officers of the Licensing Division, in relation to licenses, registrations, permits and consents, under the scheme of delegation.

The Committee discussed the most appropriate format for ensuring that members receive information about decisions taken by Authorised Officers.

Resolved - That the report be noted.

1614 APPEALS SUBMITTED TO THE MAGISTRATES COURT - The Director: Governance and Partnerships confirmed that there had been one appeal submitted to the Magistrates Court, following a decision of the Licensing (Miscellaneous) Sub-Committee. The appeal was scheduled for 2 August 2019.
