1932 MINUTES - Resolved - That the minutes of the proceedings of the meeting held on 16 January 2019, having been printed and circulated amongst the members, be taken as read and correctly recorded and be signed by the Chairman.

1933 APPLICATIONS DEFERRED FROM PREVIOUS MEETING - In accordance with the decisions at the previous meeting, members had undertaken site visits on the morning of the meeting. The Group Manager- Development Management submitted reports and updated them orally.

(i) PA/2018/1939 by Mrs Janette Weaver for planning permission to erect a detached house and garage at 27a Ferry Lane, Winteringham, DN15 9NT.

The applicant addressed the committee stating her needs and requirements for the application, and the reason she had for submitting the application and returning to the village

Cllr Marper raised concern's regarding flooding in the area, and was disappointed there had been no comment from Anglian Water. She believed it was against a number of policies and in the open countryside, and felt it would set a president for all other properties in the area.

Resolved - That planning permission be approved in accordance with the recommendations contained within the report.

1934 MAJOR APPLICATIONS - The Group Manager - Development Management submitted a report containing details of major applications for determination by the committee, including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.

(i) PA/2018/1581 by Mr Mark Snowden, Keigar Homes Ltd for outline planning permission for a residential development (with all matters reserved for subsequent approval) at land off Howe Lane and Hawthorne Gardens, Goxhill.

Five objectors spoke against the application. In doing so they raised a number of concerns, some of them being: the development was in open countryside, the area could not support the additional growth, increased traffic, narrow roads, congestion, noise disturbance, loss of greenspace, not in a sustainable area, detrimental impact on wildlife and felt it would turn Goxhill into a small town and not a village.

The applicant addressed some of the concerns raised by the objectors and referred to the officer's report. In doing so stated that there was a requirement in the area for families to grow and remain in the village, he said it was a sustainable location with good cycle and pedestrian routes available. He stated that the development would be of a high standard, with a variety of properties in keeping with the area.

The Group Manager- Development Management and Building Control gave an update on the application.

Cllr Wells was concerned with a number of issues regarding the application and felt a site visit would be beneficial to the committee before making a decision.

Resolved – That the application be deferred to the next meeting to allow the committee to visit the site

(ii) PA/2018/2404 by Mr Mark Snowden, Keigar Homes Ltd for planning permission to erect 77 dwellings with associated garaging, new estate access road and open space area at land north of Dartmouth Road, Scunthorpe.

Five objectors spoke against the application and explained in detail why they opposed the development, and their concerns covered the following areas:- loss of green space, highway safety concerns, especially near the bend and on a busy school and bus route, flood risk and associated drainage problems, they felt that the retention of the playing field that had been used for years, and is still used would be much more beneficial to the community. They stated there would be a loss of wildlife and the air quality would suffer from the loss of trees.

The applicant responded to the concerns of the residents and also felt that a lot of the issues had been addressed through the consultation meeting that was held. He stated that it was an allocated housing site, well positioned and close to the amenities. He said the plot was suitable for 91 dwellings but had only proposed 77 and there would be no loss of amenities to local residents, He also stated that there were no detrimental safety impact and the highway.

The Group Manager- Development Management and Building Control gave an update on the application regarding the response from Severn Trent Water and Sport England.

Cllr Swift spoke as the local ward member. He agreed with the concerns raised by the local objectors and petitioners, and urged the committee to have a site visit before making their decision.

Resolved - That the application be deferred to the next meeting to allow the committee to visit the site

1935 PLANNING AND OTHER APPLICATIONS - The Group Manager - Development Management submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications. The Head of Development Management updated the reports orally where appropriate. Other officers attending gave advice and answered members' questions as requested.

(i) PA/2018/469 by Mr Nev Burbage for planning permission to erect three dwellings with associated parking and garden areas, including demolition of dwelling and outbuildings at 10 Haxey Lane, Haxey, DN9 2NE.

An objector addressed the committee with worries about her own property that was attached to the dwelling to be demolished. She also had concerns around speeding traffic and flooding in the area.

Cllr Rose spoke as the ward member and was disappointed there had been no consultation with local residents, he was also concerned liked the previous speaker about the access and egress which could be problematic. He stated there was limited parking and urged the committee to refuse the application.

Cllr Collinson made reference to the conditions and felt the times within condition seven should be modified in respect of the local residents to more suitable hours of 8.30am - 6pm Monday to Friday, and 8.30am - 1pm on a Saturday.

Resolved - That planning permission be granted in accordance with the recommendations contained within the report, with the amendment to the following condition-

  • 8.30am to 6pm Monday to Friday
  • 8.30am to 1pm on Saturdays.

(ii) PA/2018/1248 by Mr Harry Flint, Four Seasons Healthcare for planning permission to replace existing southern boundary wall at Beech House Residential Home, Chapel Lane, Barton upon Humber, DN18 5PJ.

Resolved - That planning permission be granted in accordance with the recommendations contained within the report.

(iii) PA/2018/1263 by Mr and Mrs Watts for planning permission to retain and complete a 1.8 metre high boundary fence to front boundary and retain a 1.8 metre high fence to remaining boundaries at Tralee, Marsh Lane, New Holland, DN19 7PY.

Resolved - That planning permission be granted in accordance with the recommendations contained within the report.

(iv) PA/2018/1675 by Mr John Cumberland for planning permission to erect a detached bungalow at 10 Southfield Close, Belton, DN9 1NT.

Resolved - That planning permission be granted in accordance with the recommendations contained within the report.

PA/2018/1718 by Mr Jonathan Dibdin for planning permission to erect eight dwellings, including garages and access at land adjacent to Ridgeway House, Mill Lane, Wrawby, DN20 8SR.

An objector raised a number of concerns at the meeting and felt that the access/egress was too dangerous and that's why the previous application was refused. He stated there had been no communication or engagement, and there was highway safety concerns. He said there was no sustainable cycle route and was not in keeping with the settlement.

Cllr Waltham spoke as the ward member and also highlighted his concerns with the volume of traffic and speed in the area, the impact it would have on local residents, and highlighted that the development was in open countryside. He asked the committee to hold a site visit before making a decision on the application.

Resolved – That the application be deferred to the next meeting to allow the committee to visit the site

(vi) PA/2018/2303 by Mr Farmer for planning application to vary condition 2 of PA/2016/777 to bring forward building line and parking spaces at the Old Chapel, Commonside, Westwoodside, DN9 2AP.

The agent spoke on behalf of the applicant indicating that the parking areas had slightly shifted forward to the previous application that was approved and it now fell onto the public highway, and that the highways officers were content with the application. She stated it did not cause any obstruction, it was a minor difference and not even noticeable.

Cllr Rose called the application in and addressed the committee. He was worried about the application and said there was already limited parking to the front, and felt it would cause additional parking problems on Commonside.

Cllr Evison had difficulties in approving this application due to the encroachment onto the public highway, he also felt it could cause some conveyancing problems in the future.

It was moved by Cllr Evison and seconded by Cllr Wells that planning permission be refused for the following reason -

The amended position of the block of town houses, being further forward than the originally approved scheme and with parking spaces overhanging the public highway, will result in a development that is out of keeping with the character of neighbouring properties, and the area as a whole. The proposal is therefore considered to be contrary to policies DS1, H5 and H8 of the North Lincolnshire Local Plan and policy CS5 of the North Lincolnshire Core Strategy.

Motion Carried.

(vii) PA/2018/2328 by Miss Tina Rodgers for outline planning permission to erect a detached three-bedroomed chalet bungalow and detached garage with appearance, landscaping, layout and scale reserved for subsequent approval at land adjacent to Fairacres, Bridge Road, Wressle, Broughton, DN20 0BN.

The agent addressed the committee and informed it that the site was an infill plot, with no objections received from statutory consultees or members of the public. He said it was a sustainable development and urged the committee to approve the application.

Cllr Mumby-Croft as ward member felt there was no detriment to the area from the proposal, and asked that the application be determined on its own merit.

Cllr Evison agreed that he could not see any detriment to the area, and that the application should be determined on its own merit.

It was moved by Cllr Evison and seconded Cllr Grant –

That planning permission be granted in accordance with the following conditions and reasons –

1.
Approval of the details of the layout, scale and appearance of the building(s), and the landscaping of the site, (hereinafter called ‘the reserved matters’) shall be obtained from the local planning authority in writing before any development is commenced.

Reason
The application has been made under Article 5(1) of the Town & Country Planning (Development Management Procedure) (England) Order 2015.

2.
Plans and particulars of the reserved matters referred to in condition 1 above, relating to the layout, scale and appearance of any buildings to be erected, and the landscaping of the site, shall be submitted in writing to the local planning authority and shall be carried out as approved.

Reason
The application has been made under Article 5(1) of the Town & Country Planning (Development Management Procedure) (England) Order 2015.

3.
Application for approval of the reserved matters shall be made to the local planning authority before the expiration of three years from the date of this permission.

Reason
To comply with the provisions of Section 92 of the Town and Country Planning Act 1990.

4.
The development hereby permitted shall be begun either before the expiration of five years from the date of this permission, or before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later.

Reason
To comply with the provisions of Section 92 of the Town and Country Planning Act 1990.

5.
The development hereby permitted shall be carried out in accordance with the following approved plans: TR/18/01, TR/18/02 and TR/18/02A.

Reason

For the avoidance of doubt and in the interests of proper planning.

6.
No above-ground works shall take place until details have been submitted to and approved in writing by the local planning authority of the make, type and colour of all external facing materials for the development and only the approved materials shall be used.

Reason
To ensure that the building is in keeping with its surroundings in the interests of visual amenity, in accordance with policy DS1 of the North Lincolnshire Local Plan.

7.
If, during development, any odorous, discoloured or otherwise visually contaminated material is found to be present at the site then no further development shall be carried out until a written method statement detailing how this contamination shall be dealt with has been submitted to and approved in writing by the local planning authority.

Reason
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other off-site receptors in accordance with policy DS7 of the North Lincolnshire Local Plan.

8.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that order with or without modification), nothing shall at any time be erected, retained, planted or allowed to grow over 1.05 metres in height above the level of the adjoining carriageway for a distance of 2 metres from the highway boundary across the site frontage.

Reason
In the interests of highway safety and to comply with policies T2 and T19 of the North Lincolnshire Local Plan.

9.
The dwelling shall not be occupied until the vehicular access to it and the vehicle parking and turning space(s) serving it have been completed and, once provided, the vehicle parking and turning space(s) shall be retained.

In the interests of highway safety and to comply with policies T2 and T19 of the North Lincolnshire Local Plan

10.
The dwelling shall not be occupied until details of the positions, design, materials and type of boundary treatment to be built/planted have been agreed in writing by the local planning authority and the agreed boundary treatment has been built/planted. Once built/planted it shall be retained.

Reason
To provide an appropriate level of screening in accordance with policies H8 and DS1 of the North Lincolnshire Local Plan.

11.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that order with or without modification), no buildings or extensions shall be erected on the site other than those expressly authorised by this permission.

Reason
To maintain the character of the development in accordance with policies DS1 and RD2 of the North Lincolnshire Local Plan.

12.
Within six months of the commencement of development, the applicant or their successor in title shall submit a biodiversity management plan to the local planning authority for approval in writing. The plan shall include:

(a) details of bat roosting features to be installed;
(b) details of nesting sites to be installed to support a variety of bird species;
(c) restrictions on lighting to avoid impacts on bat roosts, bat foraging areas, bird nesting sites and sensitive habitats;
(d) provision for hedgehogs to pass through any fencing installed between gardens and between areas of grassland;
(e) prescriptions for the planting and aftercare of native trees and shrubs of high biodiversity value;
(f) proposed timings for the above works in relation to the completion of the building.

Reason
To conserve and enhance biodiversity in accordance with policies CS5 and CS17 of the North Lincolnshire Core Strategy.

13.
The biodiversity management plan shall be carried out in accordance with the approved details and timings, and the approved features shall be retained thereafter, unless otherwise approved in writing by the local planning authority. The applicant or their successor in title shall submit photographs of the installed bat roosting and bird nesting features, within two weeks of installation, as evidence of compliance with this condition.

Reason
To conserve and enhance biodiversity in accordance with policies CS5 and CS17 of the North Lincolnshire Local Plan.

Motion Carried.

(viii) PA/2018/2356 by Mr and Mrs J & M Stanton for planning permission to erect a detached bungalow and detached garage, and relocate existing garden shed at land adjacent to Trout Pres, Little Lane, Wrawby, DN20 8RW.

An objector spoke on behalf of a number of residents who objected to the application. In doing so he stated that the site was outside the building line, concerns regarding building and access on Little Lane, increased traffic and Little Lane was too narrow and dangerous with no footpath.

The agent stated that the development was in a sustainable village, with transport available with good education facilities. He highlighted it was just a little out of the boundary but had ample parking, ample room for lorries and no highways objections had been received.

Resolved - That planning permission be approved in accordance with the recommendations contained within the report.

(ix) PA/2018/2382 by Mr Nolan Bennett, North Lincolnshire Council for planning permission for change of use of building to higher education facility, including the installation of two external staircases at Civic Centre, Ashby Road, Scunthorpe, DN16 1AB.

Cllr Gosling as the local ward member stated that he hoped that the new lease provision had taken into consideration overflow car parking for the Pods that was the Civic Centre car park. He also stated that students would be walking between the college sites and would like to see a safer walkway provision with lights and CCTV.

Resolved - That planning permission be deferred to the Group Manager - Development Management and Building Control pending the outcome of outstanding information. Once the information was received, and deemed to be acceptable, the Group Manager - Development Management and Building Control is authorised to approve the development in accordance with the recommendations contained within the report.

(x) PA/2018/2480 by Mr Nolan Bennett, North Lincolnshire Council for listed building consent for change of use of building to higher education facility, including the installation of two external staircases and internal alterations at Civic Centre, Ashby Road, Scunthorpe, DN16 1AB.

Resolved - That planning permission be deferred to the Group Manager - Development Management and Building Control pending the outcome of outstanding information. Once the information was received, and deemed to be acceptable, the Group Manager - Development Management and Building Control is authorised to approve the development in accordance with the recommendations contained within the report.

(At this stage in proceedings having declared a personal and prejudicial interest Cllr J Davison left the meeting for the following item).

(xi) PA/2018/2501 by Marjara Care Group for planning permission to retain a building housing a biomass boiler and a pellet storage area, and to retain an external flue at Sycamore Lodge Nursing Home, 2 Burringham Road, Scunthorpe, DN17 2BB.

Speaking on behalf of a number of concerned residents an objector raised issues with regard to car parking, and informed the committee that the application would only make the situation worse in the area for parking problems.

The agent also spoke and indicated that the application was a valuable contribution against climate control with significant carbon reduction. He also stated that it had no effect on the local community.

Cllr Grant and Collinson raised concerns with the parking situation, and felt that this would only cause more parking problems in the area.

Resolved - That planning permission be granted in accordance with the recommendations contained within the report.

(Cllr J Davison returned to the meeting).

(xii) PA/2018/2515 by Euro Garages Limited for planning application to remove condition 9 of PA/2018/1384 regarding opening hours at land off Ferriby Road, Barton upon Humber.

An objector informed the committee that the application if approved would be detrimental to local residents within the area if 24 hours trading was allowed. He has concerns on the noise, lights from cars, fumes and would be a resting place for cars on an evening.

Cllr K Vickers referred the committee to when the application was approved and incidated this was an important condition in the approval. He stated that without the condition in place it would be detrimental to local residents and the amenity.

Cllr Evison agreed with the previous speakers concerns and said it would be detrimental to local residents if it was approved.

It was moved by Cllr Evison and seconded by Cllr Longcake -

That planning permission be refused for the following reason -

The proposed removal of condition 9 would result in an unacceptable impact on the amenity of neighbouring residential properties as a result of noise and disturbance at unsocial hours. The proposal is therefore contrary to policy DS1 of the North Lincolnshire Local Plan.

Motion Carried.

1936 APPLICATION FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE PLANNING PERMISSION

(i) PA/2018/1118 for approval of reserved matters in connection with permission 2014/0881 land adjacent to the White Swan public house, Butts Road, Barton upon Humber.

The Group Manager, Development Management and Building Control submitted a report informing members about this application for approval of reserved matters which was ready for determination. Outline planning permission had already been granted and the development had therefore been agreed in principle.

Consideration was now required to the details of the scale, appearance, and layout and landscaping of the development.

Resolved - That approval be granted in accordance with the recommendation contained in the report.

1937 CONSULTATIONS BY OTHER AUTHORITIES OR BODIES - 2018/2496 BY 4 RECYCLING LTD FOR CHANGE OF USE OF LAND AND BUILDINGS TO A RECYCLING FACILITY INCLUDING ERECTION OF TANKS AND CONTAINMENT BAYS FOR BIO SOLIDS TREATMENT, WASTE TREATMENT AND WASTE STORAGE FACILITY WITH THE FINAL PRODUCT USED AS SOIL IMPROVERS AND FERTILISER REPLACEMENT AT PEAT WORKS, READING GATE, SWINEFLEET, EAST RIDING OF YORKSHIRE - The Group Manager, Development Management and Building Control submitted a report on this application which the Council had been consulted by East Riding of Yorkshire Council.

Cllr's Briggs, Reed and Waltham spoke on the item and highlighted their concerns, particularly with potential odour problems that could cross the boundary into North Lincolnshire. They strongly objected to the proposal and asked the committee to formally object to the application.

Resolved - That East Riding of Yorkshire Council be advised that North Lincolnshire Council wishes to register an objection on insufficient information relating to odour from the proposed facility and the potential impact on the Thorne Moors.
