2019   PLANNING AND OTHER APPLICATIONS - The Group Manager - Development Management submitted a report incorporating a schedule containing details of applications for determination by the committee including summaries of policy context, representations arising from consultation and publicity and assessment of the applications.  The Head of Development Management updated the reports orally where appropriate.  Other officers attending gave advice and answered members’ questions as requested.

(i)  PA/2019/147 by Mr Ben Jackson, Norman Jackson Farming for planning permission for storage lagoon for liquid organic waste at land south of Mickleholme Farm, access road to Mickleholme Farm, Appleby, DN15 0AD

Cllr Waltham addressed the committee and referred to the Appleby  Neighbourhood Plan which he stated had been consulted on very widely and the Parish Council had submitted detailed concerns in relation to this type of development.  He stated it would compromise the neighbourhood amenity and was against planning policies CS1/CS2 and CS3referring to agricultural activity and the adverse impact the odour would have.

Cllr Evison was in agreement with the last speaker and referred to development as being a large vast area, possibly water contamination and had great concerns with regard to the odour for the surrounding neighbourhoods. He felt it was against planning policies especially DS1 and DS11.

It was moved by Cllr Evison and seconded by Cllr J Davdison -

That planning permission be refused for the following reasons:

‘The proposed development would have an unacceptable impact on the local environment and the amenity of local residents as a result of odour generated by the storage of liquid waste and as such would be contrary to policy CS2 of the North Lincolnshire Core Strategy and policies DS1 and DS11 of the North Lincolnshire Local Plan.?’

Motion Carried.

(ii)  PA/2020/53 by Miss Isla Bowman, Persimmon Homes (Yorkshire) Ltd for planning permission to form a lay-by and retain foul and surface water pumping station, including associated infrastructure at land west of Scotter Road, Scunthorpe.

The representative of the applicant spoke on the application that had been deferred from the last meeting to look at alternative options available.  Unfortunately he stated there were no other options for the pump station and felt the lay by options were demonstrated to be safe, and would rely on the conditions to police that.

Councillor L Foster had concerns over the application and felt he could not vote in favour of the application.

Resolved - That planning permission be granted in accordance with the recommendations contained within the report.

(iii)   PA/2020/72 by Mrs M Mikolajczyk for planning permission to erect a pair of semi-detached dwellings, including associated works at land to the rear of The Grey House, South End, South Ferriby, DN18 6HT

Resolved - That planning permission be granted in accordance with the recommendations contained within the report.

(iv)   PA/2020/152 by A Mercer and A Kendall for planning permission to erect a rear, one-and-a-half-storey extension, detached garage and detached workshop/greenhouse, install two dormer windows in the front elevation, and erect 1.4 metre and 2.4 metre high boundary walls at 3 School Lane, Appleby, DN15 0AL

The agent spoke on behalf of the applicant, and in doing so highlighted that the request was for a 2 metre wall and not a 2.4 metre wall, this was also confirmed by the planning officer present.  He also stated that the concerns of the Parish Council raised some confusion over the retention of the hedges, and that the hedge to the front would remain.

Cllr Waltham addressed the committee with some concerns, and urged the committee to take a look at the site before making a decision.

Resolved - That the application be deferred to the next meeting to allow the committee to visit the site.

(v)   PA/2020/158 by Mr P Craven for outline planning permission to erect five dwellings with all matters reserved for subsequent consideration at land north of Wheelgates, Brigg Road, Hibaldstow, DN20 9PB

Resolved - That planning permission be granted in accordance with the officer’s recommendation contained within the report.

(vi)   PA/2020/319 by K Burnie for planning permission to erect a rabbit shelter and change the use of a bedroom for dog grooming at 172 Messingham Road, Scunthorpe, DN17 2DB

Cllr Grant addressed the committee as the local ward member and highlighted his concerns with the application. His main concern was how close the rabbit shelter was to neighbouring properties at the back of the property. He said it was within 5/6 metres of the neighbours and urged the committee to hold a site visit.

Cllr J Davidson stated it was a very large structure and so close to the neighbour’s boundary, and he was worried it would attract rodents. He also had concerns with traffic parking at the front of the property as it was marked with double yellow lines.

It was moved by Cllr J Davidson and seconded by Cllr Evison-

That planning permission be refused for the following reasons:

1.
The rabbit shelter, due to its scale, use and proximity to the party boundary, would have an unacceptable impact on the amenity of the neighbouring residential property to the rear. The proposal is therefore contrary to policies DS1 and DS4 of the North Lincolnshire Local Plan.

2.The proposed development would have an unacceptable impact on highway safety as a result of the traffic generated by the existing and proposed commercial uses and the lack of appropriate on or off-street parking provision. The proposal is therefore contrary to policy DS4 of the North Lincolnshire Local Plan.

Motion Carried.

(vii)   PA/2020/332 by Mr & Mrs Whelpton for planning permission to erect a dwelling including associated works at land adjacent to 24 Main Street, Thornton Curtis, DN39 6XW

The agent for the application briefed the committee on the application and how it would fit in with the current street scene.

The Planning Officer provided an update from the archaeologist who requested that an additional condition be placed on it was permission to be granted.

Resolved - That planning permission be granted in accordance with the officer’s recommendations outlined in the report, with the addition of the following conditions:

9.
No development shall take place until the applicant, or their agents or successors in title, has secured the implementation of an archaeological mitigation strategy, to be defined in a written scheme of investigation that has been submitted to and approved in writing by the local planning authority. The strategy shall accord with a brief provided by North Lincolnshire Historic Environment Record and shall include details of the following:

(i)       measures to ensure the preservation by record of archaeological features of identified importance

(ii)     methodologies for the recording of the historic buildings and recovery of archaeological remains, including artefacts and ecofacts

(iii)     post-fieldwork methodologies for assessment and analyses

(iv)     report content and arrangements for dissemination, and publication proposals

(v)     archive preparation and deposition with recognised repositories

(vi)     a timetable of works in relation to the proposed development, including sufficient notification and allowance of time to ensure that the site work is undertaken and completed in accordance with the strategy

(vii)     monitoring arrangements, including the notification in writing to the North Lincolnshire Historic Environment Record of the commencement of archaeological works and the opportunity to monitor such works

(viii)     a list of all staff involved in the implementation of the strategy, including sub-contractors and specialists, their responsibilities and qualifications.

10.
The applicant shall notify the local planning authority in writing of the intention to commence the archaeological site works at least one week/seven days before commencement. Thereafter, the archaeological mitigation strategy shall be carried out in accordance with the approved details and timings.

11.
A copy of any analysis, reporting, publication or archiving required as part of the mitigation strategy shall be deposited at the North Lincolnshire Historic Environment Record within six months of the date of completion of the development hereby approved by this permission or such other period as may be agreed in writing by the local planning authority.

Reason for conditions 9-11

To comply with paragraph 199 of the National Planning Policy Framework, policy CS6 of the North Lincolnshire Core Strategy, and policy HE9 of the North Lincolnshire Local Plan because the site potentially contains archaeologically significant remains that the development would otherwise destroy; the archaeological mitigation strategy is required in order to preserve archaeological evidence by means of a comprehensive record and creation of a permanent archive, to advance public understanding. The archaeological mitigation strategy must be prepared and approved for implementation prior to the commencement of any groundwork within the application site that would otherwise result in destruction without record.

(viii)  PA/2020/454 by Mr & Mrs Duncan Sharp for outline planning permission to erect a detached dormer bungalow with appearance, landscaping, layout and scale reserved for subsequent consideration (re-submission of PA/2019/789) at land adjacent to The Engine House, Crowle Bank Road, Althorpe, DN17 3HZ

Resolved - That planning permission be granted in accordance with the officer’s recommendations contained in the report.
