PRESENT: – Councillor Clark (Vice-Chairman) in the chair.

Councillors Ali, Evison, Kataria, Oldfield, O'Sullivan, Wells attended the meeting in accordance with Procedure Rule 1.37(b).

The sub-committee met at the Civic Centre, Scunthorpe.

1560 MINUTE 1550 - The Director: Governance and Partnerships informed the sub-committee that information had come to light from the Licensing Authority that required members to reconsider the decision to award a Hackney Carriage Drivers Licence to the applicant.

The Director: Operations provided the members with an account of how the application came to being considered, and identified options open to the sub-committee.

Members discussed the Directors representation, as well as seeking legal advice from the Director: Governance and Partnerships.

Resolved - Members were informed at today's meeting that the application from Mr Zaman for a Hackney Carriage Drivers Licence, which the Licensing Authority presented at the hearing on the 1st November 2018, was not a valid and complete application in accordance with the council Hackney Carriage and Private Hire Policy. Consequently, when the sub-committee made the decision on the 1st November to grant Mr Zaman's Hackney Carriage Drivers' Licence, the members were unaware that the application was in-complete.

In consideration of this and the representations made by the Licensing Authority, the sub-committee hereby declare its decision made on 1 November 2018 to grant Mr Zaman's hackney carriage driver's licence to be void.

The decision made to grant Mr Zaman his Private Hire Vehicles Drivers Licence was to remain in full as the application presented at the hearing on the 1st November 2018 was considered to be accurate and the relevant considerations of the sub-committee were made in accordance with the provisions of the Local Government (Miscellaneous) Provisions Act 1976 and the council's Hackney Carriage and Private Hire Policy.
