The sub-committee met at the Civic Centre, Scunthorpe.
1319 CHAIRMAN – Resolved – That Councillor K Vickers be and he is hereby appointed chairman for the meeting.
Councillor K Vickers thereupon took the chair.
1320 DECLARATIONS OF DISCLOSABLE PECUNIARY INTERESTS, PERSONAL OR PERSONAL AND PREJUDICIAL INTERESTS AND SIGNIFICANT CONTACT WITH APPLICANTS, OBJECTORS OR THIRD PARTIES (LOBBYING) - There were no declarations of disclosable pecuniary interests, personal or personal and prejudicial interests or significant contact with applicants, objectors or third parties.
1321 (38) LICENSING ACT 2003 - APPLICATION TO VARY A PREMISES LICENCE, AM PM EXPRESS, 12 SCOTTER ROAD, SCUNTHORPE – The Director of Places submitted a report advising members of an application for the variation of a premises licence at AM PM Express, 12 Scotter Road, Scunthorpe.
Details of the application were outlined in the report, together with the application for the variation of a premises licence, a letter of objection from Environmental Health (Commercial), a representation from Humberside Police, a representation from Humberside Fire and Rescue Service, a representation from the Director of Public Health, a letter of objection from local ward member Councillor O'Sullivan, six letters of objection from interested persons and a location map.
The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:
- To refuse to vary the licence.
- To vary the licence with additional conditions.
- To vary the licence without additional conditions.
- To vary the licence but restrict the licensable activities.
- To vary the licence with restricted times.
A representative from Environmental Health, (Commercial), Councillor O'Sullivan and three interested persons addressed the sub-committee and responded to questions.
Following the summary of the case, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: –
Resolved - That after carefully considering the representations made by all parties, the sub-committee agreed to vary the licence, subject to the inclusion of the following conditions –
1. That all deliveries to the premises take place between the hours of 08:00 hours and 20:00 hours.
2. That signage be displayed at the premises, to remind customers using the premises to turn off their car engines and turn down the volume of car stereos.
These conditions were to adhere to the prevention of public nuisance licensing objective.
The conditions would prevent the increase of noise to all local residents
