2          NORTH LINCOLNSHIRE PUBLIC SPACES PROTECTION ORDER 2021 – The Deputy Chief Executive and Executive Director: Commercial and the Interim Director: Children and Community Resilience submitted a joint report seeking approval for the declaration of the North Lincolnshire Public Spaces Protection Order 2021 (PSPO).

North Lincolnshire was committed to ensuring that people who live, work and visit North Lincolnshire, enjoy good community wellbeing and prosperity.

The council declared its first Public Spaces Protection Order in October 2017 under the Anti-social Behaviour, Crime & Policing Act 2014. The powers within the PSPO 2017 enabled the council to support the vulnerable and target those who continued to be a nuisance within our local communities.

The conditions included within the current PSPO 2020 would expire on 21 October 2021. The proposed new conditions were detailed in the report at paragraph 2.3, with relevant maps contained within Appendix 1. A copy of the draft Public Spaces Protection Order 2021 and relevant definitions were contained within Appendix 2. The legislation took into account the principle of reasonable excuse in establishing whether an offence had been committed.

Resolved – (a) That the declaration of the North Lincolnshire Public Spaces Protection Order 2021 be approved, (b) that the conditions set out at paragraph 2.3 of the report be included in the PSPO 2021, and (c) the enforcement of the controls within the PSPO be undertaken in a fair and proportionate manner in accordance with the Council’s Enforcement Policy.
