Resolved - That Councillor K Vickers be and he is hereby appointed chairman for the meeting.

Minutes:

There were no declarations of Disclosable Pecuniary Interests, Personal or Personal and Prejudicial interest.

The Director: Operations submitted a report advising members of the receipt of a Temporary Event Notice at the Black Bull Inn, Townside, East Halton for an event on Saturday 14 August 2021.

 

Details of the Temporary Event Notice were outlined in the report, together with the notice, a letter of objection from Environmental Health (Commercial), a location map and additional documentation submitted by Environmental Health (Commercial) and the premises user’s representative, both with the return of their counter notices.

 

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

 

Ø  To issue a Counter Notice.

Ø  Not to issue a Counter Notice.

Ø  Impose relevant conditions (only where the event has an existing premises licence)

 

Environmental Health (Commercial) and the premises user’s representative addressed the sub-committee and responded to questions.

 

Following clarification and the summary of each case, the meeting was adjourned for deliberation by members and then reconvened when the decision of the sub-committee was stated as follows: -

 

Resolved – That after careful consideration of all the information contained within the agenda bundle and evidence submitted with the counter notices, and following the verbal presentations by the applicant and representative of the council’s Environmental Health service at the hearing, the Licensing (Activities) Sub-Committee unanimously agreed to not issue a counter notice and grant the Temporary Event Notice as applied for, as the sub-committee were sufficiently assured that the licensing objectives would be adhered to in order to prevent a public nuisance. 

 

As an advisory note, the Sub-Committee would remind the Applicant to be mindful of local residents and monitor noise levels throughout the event as much as practicable.  The Applicant should continue to comply with his existing premises licence and if he has any queries regarding this he should contact the Licensing Department
