Minutes:

Resolved - That Councillor K Vickers be and he is hereby appointed chairman for the meeting.

Minutes:

Councillor Armitage declared a personal interest as a personal licence holder.

 

No lobbying was declared.

The Director: Operations submitted a report advising members of an application for the grant of a premises licence at Central England Co-operative Ltd, former Kingsway House, East of Kingsway Road, Scunthorpe.

 

Details of the application were outlined in the report, together with the application for the grant of a premises licence and representations received from Humberside Police, Humberside Fire and Rescue Service, the Council’s Environmental Protection department, the Council’s Trading Standards department and one Interested Party.

 

The Director in his report reminded the sub-committee that the options available to it under the Licensing Act 2003 when considering such applications were:

 

Ø To refuse to grant the licence.

Ø To grant the licence with additional conditions.

Ø To grant the licence without additional conditions.

Ø To grant the licence but restrict the licensable activities.

Ø To grant the licence with restricted times

 

The applicant’s representatives and the interested party’s representative addressed the sub-committee and responded to questions.

 

The sub-committee agreed to a short adjournment for advise and to seek clarification from Legal and Democratic Officers.

 

The sub-committee reconvened and all parties summarised their case.

 

The meeting was adjourned for deliberation by members.  The decision of the sub-committee was communicated to all parties.

 

Resolved - The Licensing (Activities) Sub-Committee carefully considered all the information contained in the agenda bundle, as well as the supporting documentation submitted by the applicant with their counter notice. After listening to all the representations made by the applicant, and the interested parties at the hearing, and taking into account the statutory guidance under s182 of the Licensing Act and the Council’s Licensing Policy, the sub-committee agreed that the application be granted subject to the following:

·         That the agreed conditions for the prevention of crime and disorder, the prevention of public safety, the prevention of public nuisance and protection of children from harm contained within the agenda bundle at Appendix A be adhered to and incorporated within the premises licence.

This was to adhere to the prevention of public nuisance, the protection of children from harm and the prevention of public safety licensing objectives.

The sub-committee gave particular weight to the fact that the premises is currently not open or trading, therefore, there was no evidence to support the concerns made by the interested parties and that a premises licence can be reviewed at any point by any responsible authority or interested parties, should such evidence present itself to suggest that the applicant is not complying with the conditions attached to the licence and/or the licensing objectives.
