Minutes:

Resolved- That Councillor K Vickers be and he was hereby appointed chairman for the meeting.

There were no declarations of disclosable pecuniary interests, personal or personal and prejudicial interests, or significant contact with applicants, objectors or third parties (lobbying).

The public are likely to be excluded from the meeting for consideration following item on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 7 of Part 1 of Schedule 12A of the Local Government Act 1972.

1977.

Exclusion of Press and Public

Minutes:

That the public be excluded from the meeting for consideration of the following item (Minute 1978 refers) on the grounds that it involved the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A of the Local Government Act 1972 (as amended).

1978.

Application for the review of a premises licence under section 53A of the Licensing Act 2003 (premises associated with serious crime or disorder)

Minutes:

The Director: Economy and Environment submitted a report that advised of an application for the review of a premises licence under Section 53A of the Licensing Act 2003.

 

Details of the review application were outlined in the report, together with the interim steps that were available to the committee.

 

The Director in their report reminded the sub-committee that the options available having considered all the relevant information were:

 

·     To modify the conditions of the licence

·     To exclude the sale of alcohol by retail from the scope of the licence

·     To remove the designated premises supervisor from the licence

·     To suspend the licence for a period not exceeding three months

 

Representatives of Humberside Police attended the meeting, made representations and responded to questions.

 

Following the summary of Humberside Police case, the meeting was adjourned for deliberation by members, with the sub-committee decision to be communicated to all parties in writing, stating the following decision –

 

Resolved – That after considering the representations made by Humberside Police at the hearing, the Sub-Committee had taken an interim step and unanimously agreed to suspend the premises licence with immediate effect, in order to ensure compliance with the licensing objectives of Crime and Prevention, Public Safety and Protecting Children from Harm.  The Sub-Committee had serious concerns in relation to the offences which the Premises License Holder (who was also the Designated Premises Supervisor) had been charged with, in particular the nature of the offences and that such offences took place at the premises.  In accordance with the provisions of the Licensing Act 2003, the Premises Licence Holder was reminded of their right to make representations against this interim step taken by the Sub-Committee, should they wish to do so.
